I, the undersigned natural person (the "Data Subject"), in accordance with the requirements of Federal Law No. 152-FZ of 27 July 2006 "On Personal Data", Federal Law No. 38-FZ of 13 March 2006 "On Advertising" (Part 1 of Art. 18), as well as the Civil Code of the Russian Federation, freely, of my own will and in my own interest, give this consent:

1. Scope of consent — choice of messaging channels

The Data Subject independently chooses one or more channels for which consent is given:

☐ Telegram (Telegram Messenger Inc.; messages are sent to the specified username or number)
☐ WhatsApp (messages are sent to the specified phone number)
☐ VKontakte — direct messages and/or community messages (messages are sent to the specified VKontakte page)

2. Composition of the personal data processed

For the purposes of giving effect to this consent, the Operator processes the following personal data of the Data Subject:

full name;
phone number;
identifiers (username, ID, link) in the selected messengers: Telegram, WhatsApp, VKontakte.

3. Purposes of personal data processing

Personal data is processed exclusively for the following purposes:

sending informational materials about the Operator's services in the field of internet marketing and customer acquisition;
sending promotional materials: offers, promotions, special conditions, announcements of events;
sending educational and useful materials directly related to the Operator's activities;
informing about changes in services, pricing and terms of cooperation.

4. List of operations with personal data

The Data Subject consents to the following operations with their personal data:

collection, recording, systematisation, accumulation, storage, updating (renewal, amendment);
use for the purposes specified in section 3;
transfer to the messenger platform operators (Telegram, WhatsApp, VKontakte) to the minimum extent necessary for message delivery;
anonymisation and destruction upon expiry of the retention period or upon withdrawal of consent.

Processing is carried out without transferring personal data to third parties for commercial purposes unrelated to message delivery.

5. Validity period of the consent

5.1. This consent is valid from the moment it is given until it is withdrawn by the Data Subject.

5.2. The Data Subject may withdraw this consent at any time by sending a written notice to the Operator in one of the following ways:

by e-mail: [email protected] — with the subject line "Withdrawal of consent to mailing";
by phone: +7 (985) 272-74-37 (with written confirmation);
by e-mail of the Operator.

5.3. After receiving notice of withdrawal of consent, the Operator must stop mailing and destroy the relevant personal data within a period not later than 10 (ten) business days.

5.4. Withdrawal of consent does not render unlawful the processing carried out before the notice of withdrawal was received (Part 5 of Art. 21 of 152-FZ).

6. Rights of the data subject

The Data Subject is aware that they have the following rights:

to receive information about the processing of their personal data (Art. 14 of 152-FZ);
to demand updating, blocking or destruction of personal data (Art. 21 of 152-FZ);
to withdraw this consent at any time (Part 2 of Art. 9 of 152-FZ; Part 4 of Art. 18 of 38-FZ);
to appeal against the actions of the Operator to Roskomnadzor (rkn.gov.ru) or to a court;
to demand that mailing be stopped by replying "STOP", "UNSUBSCRIBE" or a similar word to any message in the messenger.

7. Representations of the Data Subject

The Data Subject represents that:

they are a capable natural person who has reached the age of 18;
they have read the Personal Data Processing Policy published on the website potokmarketing.ru/privacy-policy;
all personal data provided (phone number, messenger IDs) belongs personally to the Data Subject;
this consent is given freely, of their own will and in their own interest, without coercion or misleading;
the Data Subject understands that refusal to give this consent does not restrict their right to receive the Operator's core services and is not a condition for concluding a contract.

8. Confirmation by the Data Subject

I hereby confirm that I have read this Consent in full, understand its content and my rights, and voluntarily give consent to the processing of my personal data for the stated purposes.

For use in an online form (alternative to a handwritten signature)

Where consent is collected via a form on the website potokmarketing.ru, the Data Subject confirms their consent by ticking the relevant checkbox in the form. Recommended wording for the checkbox:

It is recommended to keep the record of consent (IP address, date, time, checkbox text) for at least 3 years in accordance with Art. 9 of 152-FZ and the explanations of Roskomnadzor.
